Terms of service

Article 1 – Scope and Seller

These Terms and Conditions (T&Cs) govern the sale of products by Jessica Abdallah (sole proprietor). Deviating T&Cs from the buyer are rejected. By placing an order, you agree to these terms.

Article 2 – Conclusion of Contract

  • Contracts are concluded only in German.
  • Offers are addressed only to end customers in Germany and Austria.
  • Customers must be at least 18 years old.
  • Product presentation is not a legally binding offer.
  • By clicking "Buy", you make a binding offer.
  • The contract is concluded when the seller accepts the offer by shipping the goods or sending a shipping confirmation email.
  • Order data is stored and copies can be requested.
  • Invoices are sent electronically by email or available in the customer account.

Article 3 – Prices and Shipping Costs

  • Prices include statutory VAT.
  • Shipping costs are shown in the shopping cart.
  • Prices valid at time of order apply.

Article 4 – Delivery and Cancellation

  • Delivery is made to the provided address.
  • Availability and delivery times are estimates, not guaranteed.
  • If ordered products are unavailable, the customer will be notified.
  • If delivery fails due to inaccessible address or absence, customer bears the costs.
  • Delivery occurs only after payment is received.
  • Multiple packages may be shipped separately, each creating a separate contract.
  • Orders can be cancelled free of charge before shipping confirmation.
  • Due to global supply issues, components may change without entitlement to replacement or price reduction.

Article 5 – Payment

  • Accepted payment methods: PayPal, Credit Card, Prepayment, Sofort (Klarna), Klarna (invoice and installment options).
  • Some payment methods may be excluded case-by-case.
  • Cash or checks are not accepted.
  • For online payments, you authorize the seller to collect payment at order time.
  • Prepayment must be made within 5 calendar days; goods reserved during this period.
  • Credit card payments may be collected after partial or full delivery.

Article 6 – Set-off and Right of Retention

  • You may only set off counterclaims if legally established or undisputed.
  • The right of retention only applies to claims from the same contract.

Article 7 – Transport Damage

  • Transport damages must be reported immediately upon receipt.
  • Failure to report does not affect statutory warranty rights.
  • Reporting helps the seller claim against the carrier.

Article 8 – Warranty

  • Consumers have 2 years warranty per EU law.
  • You may demand repair, replacement, refund or price reduction if products are defective.
  • Non-consumers receive replacement or repair.
  • Costs for non-warranty repairs are borne by the consumer.
  • Warranty repairs must be authorized by the seller.

Article 9 – Liability Limitations (Products)

  • The seller is not liable for damages from injury to life, body, health, or essential contractual obligations except in cases of intent or gross negligence.
  • The Product Liability Act remains unaffected.

Article 10 – Right of Withdrawal

  • Consumers have the right to withdraw within 14 days without giving reasons.
  • The withdrawal period starts upon receipt of the last item.
  • Withdrawal must be declared clearly by email to the seller:

  • Withdrawal is effective if sent before the deadline and goods are returned in time.
  • We will refund payments within 14 days after withdrawal notification.
  • Refunds use the original payment method.
  • We may withhold refund until goods are returned or proof of return is provided.
  • Return the goods within 14 days to the above address.
  • You are liable only for diminished value caused by handling beyond inspection.
  • No withdrawal right for custom-made or personalized goods and if return conditions are violated.

Article 11 – Data Protection

  • Personal data is collected with your consent and not shared without it.
  • Internet data transmission may have security risks; liability is excluded.
  • Contact data may not be used for commercial purposes without permission.
  • You have rights to access, correct, delete or restrict your data.

Article 12 – Cookies

  • Cookies may be used to improve website functionality and user experience.
  • Cookies can be session-based or persistent.
  • You can reject or delete cookies via browser settings or consent banner.

Article 13 – Jurisdiction and Applicable Law

  • German law applies exclusively; UN sales law is excluded.
  • For merchants and public law entities, court jurisdiction is the seller’s location.

Article 14 – Dispute Resolution

The European Commission provides an online dispute resolution platform. We are not obliged or willing to participate in dispute resolution before a consumer arbitration board.

Article 15 – Final Provisions

  • Contract language is German.
  • Failure to enforce rights does not waive future enforcement.
  • We reserve the right to change website, rules, and T&Cs anytime. The T&Cs valid at order time apply.
  • If any provision is invalid, the rest remain effective.
  • Product descriptions are non-binding; no liability for typos or errors.
